This Privacy Policy ("Policy") describes how Robert Alec Jenis, doing business as Vers.us ("Vers.us," "we," "us," or "our"), collects, uses, discloses, and protects information obtained from users ("you" or "your") of the Vers.us mobile application (the "App") and associated website located at www.playvers.us (the "Website," and together with the App, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree with this Policy, you must not access or use the Service.

1. Information We Collect

We collect information that you provide directly, information generated through your use of the Service, and information from third-party sources as described below.

1.1 Information You Provide Directly

When you create an account, participate in battles, or otherwise interact with the Service, you may provide:

Account Information: Your full name, email address, username (which serves as your display name), date of birth, and profile avatar photo.
User Content: Photos, videos, and other media you submit as battle entries, as well as any comments, votes, or other interactive content you post through the Service.
Transaction Information: Records of in-app purchases, including purchases of virtual currency ("v$") and subscriptions ("Vers+"), processed through Apple's In-App Purchase system.
Communications: Information you provide when contacting us for support, reporting content, or providing feedback.

1.2 Information Collected Automatically

When you access or use the Service, we may automatically collect:

Device Information: Device type, model, operating system and version, unique device identifiers, and app version.
Usage Data: Information about how you interact with the Service, including battle participation, voting activity, features accessed, time spent in the App, and crash and performance data.
Log Data: Internet Protocol (IP) address, browser type (if accessing the Website), access times, pages viewed, and referring URLs.

1.3 Information from Third-Party Sources

We may receive information about you from third-party services integrated with the App, including authentication providers and payment processors, to the extent you have authorized such sharing.

2. How We Use Your Information

We use the information we collect for the following purposes:

To provide, operate, maintain, and improve the Service, including facilitating battles, processing votes, calculating rankings, and administering the virtual currency system.
To create and manage your account, authenticate your identity, and verify your age.
To process transactions, including purchases of v$ and Vers+ subscriptions.
To communicate with you, including sending transactional notifications (such as battle results, account activity, and system updates) and, where you have opted in or not opted out, promotional communications via push notifications, email, or SMS.
To enforce our Terms of Service, including content moderation, fraud prevention, and detection of abuse or violations of our policies.
To respond to your inquiries, support requests, and feedback.
To monitor and analyze usage trends, diagnose technical issues, and improve the performance and security of the Service.
To comply with applicable laws, legal processes, or governmental requests.
To protect the rights, property, and safety of Vers.us, our users, and the public.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

Service Providers. We share information with third-party service providers who perform services on our behalf, including cloud hosting and data storage (Supabase, Cloudflare), payment and subscription management (RevenueCat, Apple In-App Purchase), error tracking and diagnostics (Sentry), application distribution and updates (Expo/EAS), and automated content moderation (OpenAI, which screens submitted photos, videos, and text for policy violations). These providers are contractually obligated to use your information only to provide services to us and in accordance with this Policy.
Other Users. Certain information is visible to other users of the Service by design, including your username, avatar, battle submissions, battle results, rankings, badges, and voting activity. You should not submit any content through the Service that you do not wish to be publicly viewable.
Sponsors and Brand Partners. If you participate in sponsored battles or brackets, your submitted content and associated username may be shared with the sponsoring brand or organization for their marketing and promotional purposes, as further described in our Terms of Service.
Legal Requirements. We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, investigate fraud, or respond to a government request.
Business Transfers. In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our Service of any such change in ownership or use of your personal information.
With Your Consent. We may share your information with third parties when you have given us your explicit consent to do so.

4. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Service. If you delete your account, we will delete your account information (including your name, email address, date of birth, and profile data). However, content you submitted as battle entries (photos, videos, and associated metadata) will be retained to preserve the integrity of completed battles and historical records. Such retained content may continue to be displayed within the Service.

We may also retain certain information as required by law, for legitimate business purposes (such as fraud prevention or resolving disputes), or to enforce our agreements. De-identified or aggregated data that can no longer reasonably be used to identify you may be retained indefinitely.

5. Children's Privacy

The Service is intended for users who are at least thirteen (13) years of age. We do not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete such information as promptly as possible. If you believe that a child under 13 has provided us with personal information, please contact us at privacy@playvers.us.

For users between the ages of 13 and 17, we encourage parents and guardians to monitor their children's use of the Service. By allowing a minor to use the Service, you (as the parent or legal guardian) consent to the collection and use of the minor's information as described in this Policy.

6. Your Rights and Choices

Account Information. You may update or correct your account information at any time through the App's settings. You may also request deletion of your account by contacting us at support@playvers.us.
Push Notifications. You may opt out of receiving push notifications by adjusting your device settings or the notification preferences within the App.
Marketing Communications. You may opt out of receiving promotional emails by following the unsubscribe instructions included in such emails or by contacting us directly. Please note that even if you opt out of marketing communications, we may still send you transactional or service-related communications.
California Residents (CCPA/CPRA). If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including the right to know what personal information we collect, the right to request deletion of your personal information, the right to opt out of the sale or sharing of personal information (we do not sell personal information), and the right to non-discrimination for exercising your rights. Other State Privacy Laws. Residents of other states with applicable privacy legislation (including but not limited to Virginia, Colorado, Connecticut, Utah, and Texas) may have similar rights. Please contact us to exercise any rights available to you under applicable law.

7. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, alteration, or destruction. These measures include encryption of data in transit and at rest, access controls, and regular security assessments. However, no method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your information, and any transmission of personal information is at your own risk.

8. International Data Transfers

The Service is currently operated in and intended for users in the United States. If you access the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to the transfer of your information to the United States.

If we expand the Service to users in the European Economic Area, the United Kingdom, or other jurisdictions with specific data protection requirements, we will update this Policy to address applicable rights and obligations, including compliance with the General Data Protection Regulation (GDPR) and similar legislation.

9. Third-Party Links and Services

The Service may contain links to third-party websites, services, or applications that are not operated or controlled by us. This Policy does not apply to such third-party services. We encourage you to review the privacy policies of any third-party services you access. We are not responsible for the content, privacy practices, or data handling of any third-party services.

10. Changes to This Privacy Policy

We may update this Policy from time to time to reflect changes in our practices, the Service, or applicable law. If we make material changes, we will provide notice through the App, by email, or by other reasonable means prior to the changes taking effect. The "Last Updated" date at the top of this Policy indicates when it was last revised. Your continued use of the Service after any changes to this Policy constitutes your acceptance of the updated Policy.
